Neurorights in Chile

In the face of neurotechnology advances, Chile passes a Neurorights law, constitutional amendment, and functionally applies it in a monumental supreme court ruling against an American corporation.

The Neurorights Foundation has worked with the Senate of the Republic of Chile, the Minister of Science and the Catholic University (Pontificia Universidad Católica: PUC) to pioneer a NeuroProtection agenda. These efforts have been coordinated by the Commission of the Future of the Senate, an office led by Senator Guido Girardi. The objective of this commission is to introduce legislation arising from advances in medicine and science.

The Neurorights Foundation has achieved some of these milestones through collaboration with the Chilean Kamanau Foundation, which promotes cutting-edge scientific and technological advances through a human rights perspective.

Milestones

September 22st, 2021: The Chilean Chamber of Deputies unanimously agrees to protect Brain data and activity under a constitutional amendment

Jan, 2019: Chair and founder Dr. Rafael Yuste meets with Senator Girardi to explore pilot constitutional amendment in Chile

October 25th, 2021: The Chilean president signs a constitutional amendment enshrining neurorights via protecting brain activity and data into effect. Approval of a neurorights bill by the senate was concurrently established.

December 17th, 2020: The Commission of the Future representing the Chilean Senate unanimously approves a constitutional amendment recognizing brain data and activity as protected under neurorights

August 9th, 2023: In a landmark ruling, Chile's Supreme Court has upheld neurorights by ordering neurotech company Emotiv to delete all brain data collected from former Senator Guido Girardi.

September 29th, 2021: Chilean lawmakers approved the passage of a law establishing the rights to personal identity, free will and mental privacy in reference to emergent neurotechnology

October 7th, 2020: The Neurorights Foundation and associates organize and present to the Chilean Congress regarding the establishment of a constitutional amendment
